Terms and Conditions of Sale

1. Seller (Merchant of Record)

HeavyM licenses are sold by Paddle.com Market Ltd, acting as Merchant of Record and authorized reseller on behalf of Digital Essence / HeavyM. Paddle handles the transaction, invoicing, applicable VAT/Sales Tax collection, as well as payment support.

2. Purpose

These Terms and Conditions of Sale govern the purchase of HeavyM software licenses (projection mapping software) via the get.heavym.net website or any associated subdomain.

3. Products and licenses

We offer several types of licenses:

• Pay Once (Lifetime): perpetual license, one-time payment, 1 year of updates included
• Rent-to-Own (Monthly): 6 monthly installments, after which the license becomes perpetual
• HeavyM EDU: education license for students and teachers at a reduced rate (-50%)
• Workshop Pack: 10 activated seats for 1 month (workshops, project weeks)
• Long-Term School Access: custom pack for schools and universities (quote-based)

4. Prices and payment

Prices are displayed in USD or EUR on the pricing page, excluding taxes. Applicable VAT/Sales Tax is calculated automatically by Paddle at checkout, based on the customer's location.

Accepted payment methods: credit/debit card (Visa, Mastercard, Amex), Apple Pay, SEPA, PayPal (subject to country availability). Payment is secured by Paddle (PCI-DSS Level 1).

5. License activation

Following validated payment, you will automatically receive by email:

• A payment receipt issued by Paddle
• A HeavyM license key generated by our provider Keygen (within a few minutes)
• The software download link

If you do not receive your license within 15 minutes, check your spam folder then submit a request via our support form.

6. Right of withdrawal and refund

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of digital content not provided on a tangible medium whose performance has begun after the consumer's express prior consent.

However, HeavyM offers a conditional satisfied-or-refunded policy. See our Refund Policy for details.

7. Intellectual property

The HeavyM software is protected by intellectual property laws. The purchase of a license grants you a personal or professional right of use, non-exclusive and non-transferable, within the limits set by your license.

The following are prohibited without prior written authorization: resale, decompilation, modification, public distribution of the source code, and any commercial exploitation of the software by a third party.

8. Limitation of liability

HeavyM undertakes to provide software in accordance with its description. However, HeavyM cannot be held liable for:

• Any data loss resulting from improper use
• Any indirect damages (loss of revenue, loss of customers)
• Any undocumented hardware incompatibility

HeavyM's maximum liability is limited to the amount paid by the customer for the relevant license over the previous 12 months.

9. Technical support

Pro+ licenses include priority technical support. Other licenses benefit from standard support via our support form, with an average response time of 24-48 business hours.

10. Modifications

HeavyM reserves the right to modify these Terms and Conditions at any time. The terms applicable to any order are those in force at the time of that order.

11. Governing law and disputes

These Terms and Conditions are governed by French law. In the event of a dispute, and after attempting amicable resolution, the French courts shall have sole jurisdiction.
